1. Acceptance of Terms

By accessing or using the Sales Performance OS platform operated by Dashboards Systems ("we," "our," or "us") at dashboards.systems, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.

2. Description of Service

Sales Performance OS is a sales management platform that provides sales teams with tools including pipeline tracking, revenue target monitoring, commission calculations, AI-powered insights ("Navi AI"), and Google Calendar integration for scheduling and follow-up management.

3. Account Registration and Google Sign-In

To use the platform, you must create an account. You may register using Google Sign-In, which grants us access to your basic profile information and, if you choose, your Google Calendar data as described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at [email protected].

4. Google API Services

Our platform integrates with Google Calendar via the Google API. By connecting your Google Account, you authorize us to access your calendar data as described in our Privacy Policy. Our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements.

You may revoke our access to your Google Account at any time through your Google Account permissions. Revoking access will disable calendar-related features within the platform.

5. Subscription and Billing

Access to the platform requires a paid subscription. Current pricing is available on our pricing page. Founding Member pricing is available to the first qualifying companies and is subject to the terms presented at time of purchase.

• Subscriptions are billed monthly or annually as selected at checkout.
• All fees are non-refundable except as required by applicable law.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Founding Member pricing is locked for the duration of continuous active subscription.

6. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any regulations.
• Attempt to gain unauthorized access to any part of the platform or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Use automated tools to scrape, crawl, or extract data from the platform.
• Share your account credentials with unauthorized parties.
• Upload or transmit malicious code, viruses, or harmful content.

7. Intellectual Property

All content, features, and functionality of the Sales Performance OS platform — including but not limited to the Navi AI system, dashboard designs, algorithms, and branding — are owned by Dashboards Systems and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for your internal business purposes only.

8. Your Data

You retain ownership of all sales data, pipeline information, and business data you enter into the platform. By using the platform, you grant us a limited license to process your data solely to provide the service to you. We do not claim ownership of your data and will not use it for purposes beyond service delivery as described in our Privacy Policy.

9. Disclaimers and Limitation of Liability

The platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that revenue projections or AI insights will be accurate.

To the maximum extent permitted by law, Dashboards Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of revenue, data, or business opportunities.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your access to the platform will cease and your data will be retained for 30 days before deletion, unless you request earlier deletion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dashboards Systems operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.
